This privacy policy will explain how our organization uses the personal data we collect from you. By accessing or interacting with any of our services or communications in any manner, you consent to this privacy policy and our procedures.

 

This policy applies to information we collect:

  • Through products and systems offered by Neuro20, including the Neuro20 PRO System (with its associated tablet app (“App”) and web-based portal (“Webpanel”)) and any other Neuro20 products or services (collectively, “Neuro20 Products”).

  • On our websites, portals, social media channels, or other online platforms.

  • In email, text, phone calls, fax, mail, and other communications between you and Neuro20 and its employees, representatives, or agents.

  • Through any interactions with our employees, distributors, resellers, or service providers acting on our behalf.

  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

 

This policy does not apply to information collected by any third party (including our affiliates), including through any application or content (including advertising) that may link to or be accessible from Neuro20 Products and services. Neuro20 is not responsible for the privacy practices of such third parties.

 

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our services. This policy may change from time to time and without prior notice. Your continued access to or interaction with our services after we make changes is deemed to be acceptance of those changes, so please review this policy periodically for updates. 

 

 What data do we collect? 

 

We collect, store, and process your personal data based on your consent. You may revoke this consent by notifying us, at any time and free of cost, at privacy@neuro20.com. This does not affect the validity of the consent until its revocation. Neuro20 collects the following data:

  • Information by which you may be personally identified, such as name, postal address, email address, telephone number, picture, or any other identifier by which you may be contacted online or offline. This includes personal identifiers (name, email address, phone number) provided when creating or managing accounts within Neuro20 products or when communicating with us for support, training, warranty claims, or other inquiries;

  • Information that is about you but individually does not identify you;

  • Information about your internet connection, the equipment you use to access Neuro20 Products and our services, and usage details;

  • Certain protected health information (PHI), including session and usage data collected through Neuro20 products, such as session duration, program type, configuration settings, and intensity or performance data;

  • Account data, such as personal identifiers (name, email address, phone number) provided when creating or managing accounts within Neuro20 products.

 

How Do We Collect Your Data?

 

You directly provide us with most of the data we collect. We collect data and process data when you:

  • Register online for any of our products or services.

  • Fill in a form through any of our platforms or communication channels, including when registering to use our products or systems, subscribing to services, requesting further services, registering warranties, making a warranty claim, or requesting technical assistance (including chatbot features). We may also ask you for information when you report a problem with our products.

  • Communicate with us, our employees, representatives, or agents via email, phone, fax, mail, or any other means of communication.

  • Voluntarily complete a customer survey or provide feedback on any of our message boards or via email.

  • Use or access Neuro20 products and services. Information may be collected automatically, including usage details, IP addresses, and information collected through cookies and web beacons (see “Automatic Data Collection Technologies” below).

  • Open a profile for use of one of our products or services.

 

When you use the Neuro20 PRO System, your account is associated with an organization. The system automatically collects session and usage data whenever it is used. Accounts may be created directly by you or by an operator or other authorized individual acting on your behalf. If an account is created on your behalf, Neuro20 is not responsible for how your information is collected from you and provided to us by that party. Accounts may also be linked to more than one organization. You will be asked to provide and verify your consent before your account and related data are shared with an additional organization.

 

We may also receive your data indirectly from the following sources:

  • Any third parties involved in the evaluation of eligibility, sale, distribution, or provision of Neuro20 products or services, including but not limited to healthcare providers (including, but not limited to, physicians, staff at physicians’ offices, nurses, physical therapy specialists, gym operators or instructors), distributors, resellers, and other service providers.

  • Health insurers.

  • Research and clinical partners, including hospitals, universities, clinical trial sites, and research organizations.

  • Government agencies and regulators in connection with reimbursement, compliance, or reporting obligations.

  • Employers or wellness program sponsors offering Neuro20 products or services to participants.

  • Third-party service providers, such as billing companies, payment processors, shipping and logistics providers, or IT vendors.

  • Marketing, advertising, and analytics partners, including social media platforms and lead-generation services.

  • Publicly available sources, such as public health databases, publications, or information you voluntarily make accessible on social media.

 

Payments 

 

If you pay by credit card, ACH, or other electronic method through a third-party payment processor (“Payment Gateway”), your information is collected directly by the Payment Gateway and not by Neuro20. The Payment Gateway processes your payment securely in accordance with industry standards (including PCI-DSS). Neuro20 does not store or have access to your full payment details. We may receive limited information from the Payment Gateway, such as confirmation of payment, transaction amount, and partial account details, which we use for record-keeping, accounting, and fraud prevention.

 

If you pay by check, direct wire transfer, ACH to Neuro20’s account, or other non-electronic means, Neuro20 may directly receive and process the information necessary to complete the transaction (such as your name, bank name, check number, or account number). Such information is used only for processing the payment and maintaining accurate records. Physical checks and related documentation are stored securely with restricted access and are disposed of in accordance with applicable financial record-keeping and data protection requirements.

How Will We Use Your Data?

 

We use the data we collect for the following purposes:

  • To present Neuro20 products and services, and their contents to you.

  • To provide you with information, products, or services that you request from us.

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

  • To notify you about changes to Neuro20 Products or services.

  • To allow you to participate in interactive features of Neuro20 Products or services.

  • To fulfill any other purpose disclosed when you provide the information, or for any other purpose with your consent.

 

We may also use your information for other purposes, including:

  • To contact you about Neuro20 Products or services that may be of interest to you.

  • To email you with special offers on products and services we think you might like.

 

We may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. If you agree, we will share your data with our partner companies so that they may offer you their products and services.

 

For users of Neuro20 products, we use account and session data to deliver services, provide technical support, improve system functionality, ensure compliance, and, where permitted, for research and product improvement. Organizations may request that Neuro20 disable session and usage data collection; however, such requests are strongly discouraged as disabling will materially limit the effectiveness of the system. Disabling may impair functionality, restrict or delay technical support, and reduce compliance with clinical, research, or regulatory requirements. If session and usage data collection is disabled, Neuro20 shall not be responsible, to the maximum extent permitted by law, for any resulting limitations in system performance, technical support, or compliance outcomes. Data not collected during any disabled period cannot be retroactively recovered.

 

 What Information Do We Collect Through Automatic Data Collection Technologies? 

 

As you use and interact with Neuro20 products, our websites, portals, social media channels, or other online platforms, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your usage of Neuro20 Products and online platforms, including traffic data, location data, logs, and other communication data and resources that you access and use on the App.

  • Information about your computer, device, and internet connection, including your IP address and operating system.

 

The information we collect automatically may include personal information. It helps us improve Neuro20 products and services, and deliver a better, and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.

  • Store information about your preferences, allowing us to customize Neuro20 Products according to your individual interests.

  • Improve system performance, including speeding up searches and navigation.

  • Recognize you when you return to Neuro20 Products or interact with our services again.

 

How Will We Disclose Your Information?  

 

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

 

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.

  • To our contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Neuro20’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Neuro20 is among the assets transferred.

  • To third parties to market their products or services to you if you have consented to these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.

  • To fulfill the purpose for which you provide it.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

 

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

  • To enforce or apply any contracts or agreements entered into between you and Neuro20.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Neuro20, our customers, or others.

 

For users of Neuro20 Products, personal and session data may also be disclosed within the organizations that use the Neuro20 PRO System, consistent with the organizational structure and permissions established by those organizations. In addition, Neuro20 personnel may access personal and session data across all organizations, but only under strict safeguards and limited to authorized personnel for the purposes of service delivery, technical support, compliance, product improvement, and, where permitted, research. Organizations that use the Neuro20 PRO System are independently responsible for how their authorized personnel handle the data accessible to them.

 

 How Do We Store Your Data? 

 

Neuro20 stores your data using secure cloud-based and physical systems designed to protect it against unauthorized access, use, or disclosure. These systems are used across Neuro20 Products, websites, portals, and services.

 

We will keep your personally identifiable information and protected health information only for as long as reasonably necessary to fulfill the purposes described in this policy, including providing services, meeting legal, contractual, and regulatory obligations, resolving disputes, and enforcing agreements. After the applicable retention period expires, your data will be deleted, anonymized, or otherwise securely disposed of in accordance with applicable laws and industry best practices.

 

 How Do We Use Your Data For Marketing Purposes? 

 

We would like to send you information about products and services of ours that we think you might like, as well as those of our partner companies.

 

If our records indicate that you are located in the United States, we may send you marketing communications by email unless you opt out. All marketing emails will include a clear way for you to unsubscribe, and you may opt out at any time by following the unsubscribe instructions provided in the message or by contacting us at privacy@neuro20.com. We do not send marketing text (SMS) messages without your prior express written consent.

 

In other jurisdictions, we will only send you marketing communications if you have provided your prior consent (opt-in). You may withdraw this consent at any time by contacting us at privacy@neuro20.com or by using the unsubscribe link in our emails.

 

If you have agreed to receive marketing, you may always opt out at a later date.

 

You have the right at any time to stop us from contacting you for marketing purposes or giving your data to our affiliates.

 What Are Your Data Protection Rights? 

 

Depending on your location, you may have certain rights regarding your personal data. For individuals located in the EU or UK, these rights include access, rectification, erasure, restriction, objection, and portability as described below. For U.S. residents, your rights may vary depending on state law (for example, some state laws provide specific rights to access, delete, or correct personal information). We will honor all rights granted under applicable law.

 

These rights may include:

  • The right to access. You have the right to request copies of your personal data from us. We may charge you a small, reasonable fee for this service.

  • The right to rectification. You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete the information you believe is incomplete.

  • The right to erasure. You have the right to request that we erase your personal data, under certain conditions.

  • The right to restrict processing. You have the right to request that we restrict the processing of your personal data, under certain conditions.

  • The right to object to processing. You have the right to object to our processing of your personal data, under certain conditions.

  • The right to data portability. You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

  • The right to opt out of sale or sharing. In some U.S. states, the right to direct us not to sell or share your personal information with third parties for targeted advertising or marketing.

 What Is Our Policy On Children And Privacy? 

 

We believe in the importance of protecting the privacy of children online. Neuro20 Products and services are not intended to solicit information of any kind from children under age of 16. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on Neuro20 Products and services. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. In the United States, we comply with the Children’s Online Privacy Protection Act (COPPA), which restricts the collection of personal information from children under the age of 13. Neuro20 does not knowingly collect information from children under 13, and if we discover that we have inadvertently done so, we will delete such information promptly.

 

 What Are Cookies? 

 

Cookies are text files placed on your computer to collect standard Internet log information and visitor behavior information. When you use Neuro20 Products, websites, portals, or other online platforms, we may use cookies or similar technologies (collectively, “Cookies”) to collect certain information. Cookies collect information such as domain, IP address, approximate geographic location, operating system, date and time of our visit, pages you visited, device type, browser language, time spent on page, scroll depth (how much of a web page was viewed), and user events (such as selecting a button).

Neuro20 may or may not use cookies and similar technologies. Where used, these may include:

  • Functionality. These cookies allow us to recognize you and remember your previously selected preferences. These could include what language you prefer and location you are in. A mix of first-party and third-party cookies are used.

  • Advertising. These cookies collect information about your visits, the content you viewed, the links you followed, and information about your browser, device, and your IP address. Also referred to as pixels and/or tracking tags, these are see-through images placed on certain pages that are typically used in conjunction with cookies and aren’t stored on your device. When you access these pages, web beacons generate a notice of your visit.

  • App or site log files. These are used as analysis tools to understand how visitors use our platforms, how often they return, and how they navigate.

  • Flash. Flash is used to assess the performance of the site and as a player for selected videos depending on the browser a device is using.

  • Local storage objects. Flash Local Storage Objects (“LSOs”) may be used to store your preferences and to personalize your visit

  • Third party cookies. Third-party cookies have multiple purposes, such as web analytics and for keeping track of users’ browsing activities to show them personalized ads.

 

 How Do You Manage Cookies? 

 

You can, in some circumstances, set your browser or device not to accept cookies, and the above website tells you how to remove cookies from your browser. However, in a few cases, such as if cookies are in use and you disable or remove them, some features of Neuro20 Products, websites, or online platforms may not function properly as a result.

 

Does Our Privacy Policy Apply To Other Websites?

 

Neuro20 Products, websites, portals, or online platforms may contain links to third-party websites or services. Our privacy policy applies only to Neuro20 Products and services. If you click on a link to a third-party website or service, you should read their privacy policy to understand how they collect and use your information.

 

Do We Change Our Privacy Policy?

 

It is our policy to post any changes we make to this Privacy Policy on our websites and online platforms. The date the Privacy Policy was last revised is identified at the top of the page. If we make material changes to how we handle your personal information, we may also provide notice by email or through a notice within Neuro20 Products.

 

HIPAA and Protected Health Information

 

Certain data collected through the use of Neuro20 Products may constitute Protected Health Information (PHI) under the U.S. Health Insurance Portability and Accountability Act of 1996 (HIPAA). Neuro20 Technologies Corp. is not a “covered entity” under HIPAA. However, in some circumstances Neuro20 may act as a “business associate” to covered entities such as healthcare providers, hospitals, or clinics. In those cases, Neuro20 will handle PHI in compliance with HIPAA and any applicable Business Associate Agreement (BAA) in place with the covered entity.

 

During registration for Neuro20 Products, if we determine that the registering individual or organization qualifies as a HIPAA-covered entity or business associate, we may require execution of a BAA in accordance with HIPAA requirements before the account or organization can be fully activated. Without a signed BAA where required, access to certain features or the ability to use Neuro20 Products with PHI may be restricted.

 

When Neuro20 acts as a business associate, our collection, use, and disclosure of PHI will be limited to the purposes permitted under HIPAA and the applicable BAA, including:

  • Providing and supporting the Neuro20 Products;

  • Maintaining system functionality and security;

  • Meeting regulatory and legal obligations;

  • Carrying out other functions expressly permitted by the BAA or HIPAA regulations.

 

When Neuro20 provides services directly to individual users (outside of a HIPAA-covered relationship), the information we collect may not be considered PHI under HIPAA. In those circumstances, the information will be treated as personal data and handled in accordance with this Privacy Policy and other applicable laws (such as state privacy laws, GDPR, or other regional regulations).

 

Healthcare providers and organizations that use Neuro20 Products are responsible for ensuring that they obtain all necessary patient consents and authorizations, and for determining when HIPAA applies to their use of Neuro20 Products.

 

California Privacy Notice

 

This California Privacy Notice applies only to individual users of our Services who are residents of the State of California, and only where we act as a “business” with or for that individual. For example, this section applies for California residents who use our products or services as an individual user or through an individual account with us (i.e., not under an account of a physician). For these users, this section is a supplement to the other parts of our policies.

This California Privacy Notice describes how we as a business collect, use, disclose, and otherwise process personal information of individual residents of the State of California within the scope of the California Consumer Privacy Act of 2018 (“CCPA”).

Right to know

Upon verifiable request we will provide you with the following information about your personal information over the prior 12 months: (1) the specific pieces and categories of personal information we have collected about you; (2) the categories of sources from which we have collected your personal information; (3) our business purposes for collecting and selling your personal information; (4) the categories of third parties with which we have shared your personal information; (5) the categories of personal information we have disclosed about you for a business purpose; and (6) if applicable, categories of personal information we have sold about you and the categories of third parties to which the personal information was sold.

Right to delete

Upon verifiable request we will delete personal information we have collected about you, subject to certain exceptions in the CCPA.

Right to opt out of sales to third parties

Right to not be subject to discrimination for enforcing your CCPA rights

You will not be discriminated against by us for your exercise of CCPA rights. However, please note that in some instances, exercising certain CCPA rights may cause us to be unable to provide you with our Services.

Please note, this section may not apply to you if you use our products or services under or in connection with an account belonging to an independent physician, hospital, or other person or entity. In these instances, please contact such entity about your personal information and your rights.

Please note that we will need to verify your identity before processing CCPA and other California requests, which may require us to request and obtain additional information from you. We will use that information only to review and address your requests. We reserve the right to decline or limit requests in certain circumstances – for example, when we are unable to verify your identity or locate information in our systems, or when you have previously made two CCPA requests in the prior 12 months, or as otherwise permitted by applicable law.

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your CCPA and other California rights. Before accepting such a request from an agent, we will require the agent to provide us with proof that you have authorized it to act on your behalf, and we may also need you to verify your identity directly with us.

Please note that we will also comply with valid requests from California residents that have an established business relationship with us under California’s “Shine the Light” law.

As regards Neuro20’s personal data processing activities regulated by the UK GDPR, such activities are carried out by Neuro20 Technologies UK Ltd., located at The Pinacle, 170 Midsummer Boulevard, Milton Keynes, England, MK9 1BP.

 

 European Union Privacy Notice 

 

If you are an individual resident of the European Union, you have certain rights with respect to your personal information, including under the General Data Protection Regulation (“GDPR”). This includes, among other rights, the right to be informed and request access to the personal information about you that we have collected via our Services. You may also have the right to ask that your personal information be corrected, updated, or deleted.

 

We process personal information only where there is a lawful basis to do so under the GDPR. In most cases, this will be because it is necessary to provide our services to you under a contract, because we have a legitimate business interest in doing so, because we are required to by law, or because you have given your consent.

 

Personal data is collected for the following purposes and on the following legal basis:

 

  • Account and contact information is used to set up and manage your account, deliver products and services, provide support and training, and handle warranty or billing issues. The legal basis is the performance of a contract and, where applicable, our legal obligations. We may also rely on legitimate interests in providing effective customer support.

 

  • General usage information is used to present and improve our products and services. The legal basis is our legitimate interests in developing and enhancing our systems.

 

  • Technical and connection information is used to ensure that our products and apps function correctly, to maintain security, and to troubleshoot problems. The legal basis is our legitimate interests in system security and performance, and the performance of our contract with you.

 

  • Session and usage data are used to enable product functionality, provide technical support, monitor effectiveness, and ensure compliance with system, clinical, or research requirements. The legal basis is the performance of our contract with you and our legitimate interests in improving and supporting the product. In the EU, where the product is not sold as a medical device, session and usage data is generally treated as technical usage data rather than special category health data.

 

  • Identifiers provided when managing your account (such as login information and profile details) are used for authentication, linking usage data to your profile, and maintaining system integrity. The legal basis is contract performance and our legitimate interest in keeping accounts secure.

 

  • Communications and participation data (traffic logs, access details, interaction history) are used to provide interactive features, monitor service quality, and enhance user experience. The legal basis is contract performance and our legitimate interests in improving our services.

 

  • Marketing communications are used to inform you about Neuro20 products, services, and offers that may interest you. We rely on your consent for direct marketing via email or phone, and you can withdraw your consent at any time. In some cases, we may rely on legitimate interests to market similar products to existing customers, in line with applicable ePrivacy rules. With your consent, we may also share your details with selected partners so they can contact you about their products or services.

 

Please note that we will comply with valid requests from residents of the European Union subject to relevant legal exemptions. Please also note that we will need to verify your identity before processing any such requests, which may require us to request and obtain additional information from you. We will use that information only to review and address your requests. We reserve the right to decline or limit requests in certain circumstances – for example, when we are unable to verify your identity or locate information in our systems, or as otherwise permitted by applicable law.

 

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under this section. Before accepting such a request from an agent, we will require the agent to provide us with proof that you have authorized them to act on your behalf, and we may also need you to verify your identity directly with us.

 

If you use our services under an account of an independent physician, hospital, or other person or entity, please contact such person or entity about your personal information and your rights.

 

Where required by law, if we become aware that we have collected personal data from a child under the applicable age of consent without appropriate authorization, we will take steps to delete that information promptly.

Consent: By submitting personal information to us, or our service providers and agents, you consent to the collection, use, disclosure, and transfer of your personal information in accordance with this privacy policy and as permitted or required by law. You may withdraw your consent at any time to the collection, use, disclosure, or transfer of your personal information time by contacting us at privacy@neuro20.com If you withdraw your consent (or if you decide not to provide certain personal information), you acknowledge that we may not be able to provide you, or continue to provide you, with certain products, services, or information that may be of value to you.

Retention of personal information: The personal information that you provide will be retained by us in accordance with applicable laws. However, we will take reasonable steps to destroy or permanently de-identify personal information we hold if it is no longer needed for the purposes for which it was collected.

Access and correction: We will take reasonable steps to ensure the personal information we hold is accurate, complete, and up-to-date. Upon your written request, and subject to certain exceptions provided by law, we will inform you of the existence, use, and disclosure of your personal information and give you access to that information. We may charge a minimal fee for providing such access to you. If you believe that the personal information that we hold about you is not accurate or complete, you may write to us at privacy@neuro20.com If you are able to establish that the information is not accurate or complete, we will take reasonable steps to delete and/or correct the information so that it is accurate, complete, and up-to-date. In order to facilitate a request to correct or update information, we may ask you to provide additional information to confirm your identity. Any such information will only be used for the purpose of confirming your identity and will not be retained by us.
