Limited Warranty

Neuro20 Technologies Corp. (“Manufacturer”) warrants the Neuro20 Pro System Control Box (the “Control Box’”) to be free from defects in material and workmanship for a period of three (3) years from the original date of purchase. Manufacturer also warrants the Neuro20 “Smart Suit” (the “Smart Suit”) to be free from defects in material and workmanship for a period of six (6) months from the original date of purchase. Manufacturer further warrants the System Protective Case, the Tablet Protective Case, the Control Box Battery, and Control Box Battery Charger for a period of one (1) year. Together, the Smart Suit, Control Box, System Protective Case, the Tablet Protective Case, the Control Box Battery, and Control Box Battery Charger shall be referred to herein as the “Product”. It is Manufacturer’s sole discretion to determine if the reported claim constitutes a claim within the scope of this Limited Warranty policy. The Operating Tablet, its Charger and Power Adapter are not covered by Manufacturer under this Limited Warranty. For warranty claims  involving such excluded items, refer to the warranty policies of the applicable third-party product manufacturers.

 

During registration, the user must provide proof of purchase and certain personal information, including name and contact details, which shall be collected, processed, and stored in accordance with the Manufacturer’s Privacy Policy. The information provided during registration will serve as the basis for any subsequent verification of warranty status. Manufacturer reserves the right to review the accuracy of any registration details, including purchase dates or ownership information, and to determine that a warranty is invalid if inaccurate information was provided, even if the warranty initially appeared active within the online portal. In certain cases, Products may have been sold without serial numbers. In such instances, the user may complete the alternate registration form provided at www.neuro20.com/register specifically designated for non-serialized Products. In all such cases, proof of purchase must be submitted and Manufacturer shall, in its sole discretion, determine eligibility for coverage. Registration and activation are required to validate and confirm warranty coverage and to ensure efficient processing. Failure to register may delay or limit available remedies under this Limited Warranty. Manufacturer may, at its discretion, accept warranty claims for unregistered Products upon sufficient proof of purchase; however, such acceptance is not guaranteed.

 

To initiate a warranty claim, the registered user shall visit www.neuro20.com/register, enter the serial number of the Product to review the warranty status, and complete the corresponding claim form. The claim must include an accurate and detailed description of the issue, together with supporting documentation such as photographs, videos, or other evidence that will assist Manufacturer in verifying and troubleshooting the problem. Manufacturer will evaluate the information provided and shall, in its reasonable discretion, determine whether the reported issue constitutes a claim within the scope of this Limited Warranty. Manufacturer may request additional documentation or evidence as necessary to reach a determination. If the claim is approved, Manufacturer will determine the appropriate resolution, which may include repair, replacement, or another suitable remedy, at its sole discretion. Warranty replacements may include refurbished components or systems.

 

Warranty claims must include a complete and accurate description of the issue, supported by any relevant photos, videos, or diagnostic data. Claims that lack sufficient detail may be delayed until adequate information is received. Manufacturer may provide additional guidance through the online form to ensure completeness.

 

The effective date of this Limited Warranty is the day of receipt of delivery of the Product to the original purchaser. All claims under this warranty must be initiated within the specified warranty period, which begins on the effective date. No extension, renewal, or continuation of this Limited Warranty is available or may be purchased, and the warranty period shall expire absolutely upon the conclusion of the applicable term stated herein, regardless of any service, repair, or replacement performed.

 

This Limited Warranty does not cover any damage caused by misuse, abuse, accidents, wear and tear from normal use, alterations to the Product, or use of the Product with components or accessories not manufactured or approved by Manufacturer. Failure to comply with all operating, storage, use, cleaning, maintenance and other instructions in the Neuro20 PRO System Operating Manual, including but not limited to the System Components and Overview section, shall void this Limited Warranty. The Smart Suit is a wearable garment that will naturally experience wear, stretching, and material fatigue through normal use. Such changes, including but not limited to loss of elasticity, seam loosening, fading, or minor fraying, are considered normal wear and tear and are not covered under this Limited Warranty. The Smart Suit is a consumable wearable component of the Neuro20 PRO System, meaning it has a limited service life as a textile-integrated electronic garment. Under normal use and care, it is expected to remain functional for the warranty period of six (6) months. After this period, normal wear, material fatigue, or performance changes are expected and are not covered under warranty. The Smart Suit incorporates proprietary flexible conductive wiring embedded within the garment structure. While these internal components are designed to flex and move with the user, they remain electronic elements within a textile. Excessive stretching, twisting, or pulling – particularly when the suit is worn too tightly or forced beyond its intended range of motion – may damage the internal wiring or seams. Such damage is not considered a manufacturing defect and is excluded from warranty coverage.

 

THIS IS MANUFACTURER’S ONLY WARRANTY/POLICY. The remedy stated above is exclusive for any and all claims by the Purchaser or any person claiming through the Purchaser against Manufacturer, whether based on contract, negligence, tort, strict liability, warranty, or under any statute or on any other basis. TO THE FULLEST EXTENT ALLOWED BY LAW, IN NO EVENT SHALL MANUFACTURER BE LIABLE, WHETHER BASED ON CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY, WARRANTY, OR UNDER ANY STATUTE OR ON ANY OTHER BASIS, FOR SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, PUNITIVE, MULTIPLE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR CAUSED BY THE PRODUCT OR THE POSSESSION OR USE OF THE PRODUCT BY THE PURCHASER OR ANY PERSON CLAIMING THROUGH THE PURCHASER – IN ALL CASES ABOVE WHETHER OR NOT FORESEEABLE AND WHETHER OR NOT MANUFACTURER IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM OR RELATED TO PERSONAL DAMAGES, LOSS OF USE, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR FOR LOSS OF REVENUE, PROFITS, EARNINGS, OR GOODWILL. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY. DAMAGES FOR ANY CLAIM, INCLUDING A WARRANTY CLAIM, MADE ON ANY BASIS ARE LIMITED TO THE PURCHASE PRICE OF THE PRODUCT FOR WHICH DAMAGES ARE CLAIMED.

 

THIS WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE. Some states do not allow limitations on how long an implied warranty lasts; therefore, the above limitation may not apply. Manufacturer neither assumes, nor authorizes any person to assume for it, any additional liability or responsibility with respect to the Product beyond this Limited Warranty. This Limited Warranty applies only to the original purchaser unless the Product is sold or transferred by an authorized distributor directly to an end user, in which case the warranty shall apply to such end user as of the date of delivery. This Limited Warranty is not transferrable between end users.

 

If upon inspection the Product is found not to qualify under this Limited Warranty, Neuro20 may offer repair or refurbishment services at standard service rates. Such services will be quoted to the Purchaser prior to commencement, and acceptance of such quotation constitutes authorization for out-of-warranty service.

All limitations and exclusions herein are agreed to and accepted by the Purchaser upon purchase of the Product. Purchaser agrees that any dispute regarding this warranty shall be resolved by arbitration in Hillsborough County, Florida. Purchaser agrees that Florida law shall be the governing law. If arbitration is deemed inapplicable by a court of competent jurisdiction, Purchaser agrees that Florida courts have proper personal jurisdiction over the parties to this Limited Warranty. To the extent required by applicable law, Purchasers may opt out of arbitration within thirty (30) days of purchase by providing written notice to Manufacturer.
